PE investors investing in rival cos should choose when taking board seats: CCI
The competition watchdog is keeping watch on private equity funds taking up board seats in rival companies in the same sector, saying such arrangements could adversely impact the competition landscape. While the Competition Commission of India (CCI) has no issues with PEs owning minority stakes in rival companies, in terms of board representation it wants these funds to choose one company and give up the directorship in the rival companies. The anti-trust regulator is also keeping an eye on PE funds making incomplete disclosures to CCI regarding the extent of influence they exert on the companies.
